2. Access and Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable right to access and use the Service:

• Install and use the Software on devices you own or control
• Use the Software for commercial purposes in connection with eBay listing creation
• Make backup copies of the Software for archival purposes

License Restrictions

You may not:

• Distribute, sell, lease, rent, or sublicense the Software
• Reverse engineer, decompile, or disassemble the Software
• Remove or modify any copyright notices or proprietary markings
• Use the Service to create competing products
• Share your account with others or attempt to bypass account limits

3. Purchase and Payment

DraftBay offers subscription-based access with a generous free tier. Payment processing is handled by Stripe. By making a purchase, you agree to Stripe's terms of service.

Free Tier and Subscription Plans

DraftBay provides a free tier with 10 drafts per month to evaluate the service. Paid subscription plans offer higher limits and advanced features. All subscriptions can be cancelled at any time through your account dashboard.

4. Software Requirements

DraftBay requires:

• A valid DraftBay subscription (includes AI processing)
• Internet connection for AI processing and updates
• Compatible operating system (Windows 10+, macOS 10.15+, or Linux)

Third-Party Services

The Software integrates with:

• Centralized AI Service: For AI-powered listing generation (included with subscription)
• eBay API: For market research and category suggestions
• Image processing services: For product analysis

AI processing is handled through our secure backend service. eBay integration requires your consent and follows eBay's terms of service.

5. User Responsibilities

You are responsible for:

• Providing accurate product information and images
• Reviewing and editing AI-generated content before use
• Complying with eBay's terms of service and policies
• Maintaining the security of your account information
• Using the service in accordance with applicable laws

6. Prohibited Uses

You may not use DraftBay to:

• Create listings for illegal, prohibited, or restricted items
• Generate false, misleading, or deceptive product descriptions
• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Spam or create excessive automated listings

7. Intellectual Property

DraftBay and all related intellectual property rights are owned by us. The Software is protected by copyright and other intellectual property laws.

User Content

You retain ownership of:

• Product images and descriptions you provide
• Listings created using the Software
• Your business data and information

8. Privacy and Data

Our collection and use of your information is governed by our Privacy Policy. The Software processes data locally when possible and only transmits necessary information to third-party APIs.

9. Updates and Support

We may provide updates to improve functionality, security, or compatibility. Updates may be automatic or require manual installation.

Support

Email support is provided for technical issues and general questions. We aim to respond within 24 hours during business days.

10. Disclaimers

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• Merchantability and fitness for a particular purpose
• Non-infringement of third-party rights
• Uninterrupted or error-free operation
• Accuracy of AI-generated content

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages exceeding the amount you paid for the Software
• Issues arising from third-party services (e.g., eBay, payment providers)

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

• Your use of the Software
• Your violation of these Terms
• Your violation of any third-party rights
• Content you create or listings you publish

13. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination:

• Your right to use the Software immediately ceases
• You must uninstall the Software from all devices
• Sections regarding liability, indemnification, and disputes survive

14. Governing Law

These Terms are governed by the laws of the United States of America. Any disputes will be resolved in the courts of the United States of America.

15. Changes to Terms
